hey noobs


just wondering if anyone knows as to what you're legally entitled to as far as like lunch breaks go in the workplace

currently me and all my fellow staff (mostly good mates) on the weekends work a 10 hour shift with 1 20minute paid break

on a busy day this basically means were standing up for 9hr 40mins non stop, washing cars, which gets tiring after a while :P

i was talking to someone who said that after 4 hours were meant to get a 1 hour break, unpaid. and something about 10 minute breaks afterwards for every x amount of hours you work

i dont know about the rest of the guys who work there, but i sure as f*** know i would rather get an hour break and then 1 or 2 10minute breaks that are unpaid, then 20 minutes break thats paid..

I think when I work for less than 5 hours I get 15 mins paid break, but if I work between 5 and 8 I get 30 mins unpaid.

I am pretty sure that there are different rules depending on how much you get paid. If you get only award wage, you are entitled to a few more things in terms of breaks and overtime pay. If you signed anything when you started working there was probably a 3 font line somewhere saying you don't get jack.

Wouldn't it depend totally on what award or AWA you are covered by, or failing that, your contract?

Though there may be some OHS laws that apply...

Yeah, I'd say it's part of your employment agreement...

By the way, I get breaks whenever the hell I want. All paid, because I'm me.

At Coles if you work more than 4 hours, you get a 10 min paid, more than 6 you get 30 min unpaid, 10 min paid, more than 7 2x10min paid, 1hr unpaid

depends on the award they are paying you under and it depends if your union has had any infulence or arrangements made

i have to have a 10minute break at 2 hrs at my work and a half an hour unpaid break for every 5hrs worked.

as far as i know as a minimum you should get this

<5 1 x 10min break

>5 <7 1 x 10 min and 30 min

>7 2 x 10 and 30 min

>10 special rates including a paid meal 2 x 30 2 x 10

i work at formula 1 carwash at tingalpa

its a pretty good job i dont mind it at all, only when we put thru 250+ cars in a day and you get a 20 minute break

times like those i wanna break my boss's neck :P

and i think its actually >4 1 x 10 min break...

i remember an employer putting us on for 3 hours instead of 4 just to cut out the 10 min break

you should be getting a paid meal as far as i know... and at least 2 x 30 min breaks... and 2 x 10's

sometimes on really hot days we get bought a gatorade each that was f***ing leet :D

but no paid meals =(

i tell you kiddies a little story wot happened to me and this very issue...

i started work for a company as a storeman full time... (long long time ago)

neway 2 weeks into the job and all we got was 1 x 30 min break during the day...

i gots a bit peeved with this and started taking my 2 x 10min breaks...

as the boss was upstairs in his office and i was downstairs with the store manager everything was fine...

till 1 day when the boss asks the store manager to explain something... i was on a 10 min break at the time... and he said... give him a few more mins... hes just on a break...

at hearing this the boss came storming downstairs all red and huffing and puffing asking what the f*** was going on and y i was taking a break...

i explained to him that taking a break was a right i had... i explained the breaks i would take at my last job and how they worked...and if as a storeman they were different i would accept that... but i would be taking all breaks permitted under the whatever award i was under...

the boss got really f***in mad that i would have the audacity to take breaks etc and for the rest of the day he was on the phone to the industrail relations trying to sort out what breaks i was entitled to... (he thought none)

neway later that day there was a big meeting to discuss it and in the end i was right we were entitled to 2 x 10s and a 30 min break paid for by the employer...

few months down the track the boss promoted me to estimator... he had told the store manager that he thought i had some balls to stand up for myself like that... and was so impressed he promopted me...

so do it for your breaks... and also for your career...

btw from your job description i would say you are award free and therefore screwed.

the beauty of the free market though is if you don't like your job you can quit.

yes if you dont plan on making it a career just take your breaks and hit the mofo up for everything your entitled to...

250+ cars a day = say 10bux a car?

2500 he pays prol 5 ppl 12x10 = 120x5 - 600

hes raking in 1900/day off your slave labour... i'm sure he can afford a few sangas and a drink.... f***in lowlife

I seriously think I'm getting ripped...

I work at Domino's Dbay, often 7+ hours of delivering pizza's straight (taking sometimes 4 - 5 deliveries at a time).

Never once have I got a unpaid break ever... let alone a paid one.

I'm sure it couldn't be legal to have 7 hours of non-stop delivering... you get death fatique.

I think for casual its 6 hours and then they have to be offered a break.

minnum price is 14 for a sedan

4x4 are 16

we dont usually do more then 250 cars, usually around 200-220 is a normal weekend.

pretty much 1 car in 3 will get a tyre shine, or some kind of extra

tyre shines add 4 onto a sedan (18), and 6 ontoa a 4x4 (22)

then you can get vaccums, etc etc

about 1 in 5 cars get a vacuum (pretty accurate estimate imho), and that brings the price up to 20 for sedan and 26 for 4x4

i do the end of day money (well used to)

and without the vacuums, a busy day would turn over like 3k.

im on 14 an hour, but there are 18 year olds who work with me who are on 18 an hour, so he pays a fair bit in wages

i reckon a 220 car day with a fair amount of extras (tyre shines vacuums etc) would pull around 4k in.

so you do the math

i work a 8hr shift, any time over that is time and a half. get a 20 min paid break, 30 min upaid break and a 5 min payed break.

breaks what is a break

i get 1x 10-15 min break a day that is it i am working any where from 10 to 14 hrs with a 15 min break and i don't get payed any awards or over time or any thing

i think it is time to leave

When i used to work in retail it was:
4 hours - 10 minutes paid
6 hours - 10 minutes paid and 30 minutes unpaid (optional 1 hour unpaid instead)
8 hours - 2 10 minutes paid and 1 hour unpaid
10 or 12 - add an extra half hour unpaid

I get 1x5min paid break every hour. If I work greater than 5 hours, I get an unpaid 30 minute break.

I get 30 mins unpaid for lunch...I usually take 40 mins anyways.

I take all the breaks I want during the day and if the boss tries to argue about it I tell him to stop taking breaks for a smoke and Ill stop taking my breaks.
