Topic: Please advise - Fu*ked over by employer. . .

I recently lost my license because I accumulated too many demerit points. I told my employer this and they terminated my employment - I understand this because I am a sales rep and I need my License to visit our clients.

I told my employer this and he said we would keep this 'between us'. Five days later he handed me my termination cirtificate, after I had been driving without a license prior to my termination letter.

The problem lies with unpaid commission for the month of August and also part of an unpaid plane ticket that they agreed to pay for after my termination.

I have spoken to my solicitor and they say I have a strong case, but as it is with all solicitors', they are very busy and unable to really focus upon my case for perhaps the next 3-4 weeks.

Any tips how I can get the money owing to me without going through my solicitor????

Please note: the last email that I received from my the former state manager had requested that all cfuture orrespondence from myself was sent to them through my solicitor.

Any advice will be gratly appreciatead.

should've made ur employer vouch for you that you need your license for ur job and get a provisionary one just for driving between clients

Find another soliciter who can do it now or wait untill they can.

Spose this'll teach you to drive according to the law ;)

So you were driving without a license while working? What was the exact reason given for your termination? Perhaps your employers didnt want you driving without a license and put them at risk for any damage you could have caused in an accident.

Just ask your solicitor to send them a dirty letter now, even if they cant deal with it for another 2-3 weeks. If they still havnt paid up then follow it up.

file a claim for unpaid wages in the industrial relations commission. most employers will pay it out just to avoid turning up.

IRC probably can't help, because hes probably trading as a business or soemthing.

Something was.. A dodgy deal. 'between us'.
Dodgy deals are differnt to full legal deals (contracts). Really the dodgy deal is only good if both sides have something to bargin with. It seems in this case Mr Kmart has/had nothing to bargin with, perhaps a little experiance.
His job was terminated when he lost his license and didnt win a work license in court. Perhaps the Employer talked to someone with and concluded that it would be best not to knowingly have a unlicesed person driving around representing his business. A single accident could cause alot of trouble involving lots of $'s.
It isnt unfair to be dismissed.

Not being payed for work done is another matter, specially if that work was done before the loss of license.
