OK, for example if i took a screen capture of someones webcam on MSN and it was of their boobs or something, they're over 18 and so am I.

She gets pissed off and does something bad to me.. Can i show the screen capture or is it illegal? The individual lives overseas in Japan and is not Australian.

She said she will call the police if i had those pictures but.. I dont actually have them.

If i did, and i did show them on the internet could i get arrested?

She lives in japan and therefore im wondering does her copyright extend here?

ALso, what if i showed pictures of her in a Gstring or something and not 100% naked?? would that make a difference??

I wouldn't think she could get you in trouble though since she was dumb enough to disseminate the data in the first place. (Webcam stream)

its also illegal to distribute said records, whether made legally or illegally without written consent.



i'd still say do it because the only person who can complain is her, and i doubt she would get in contact with QPS over this.

Dopefish, well if you screenshot the picture here, then you are in QLD and the offense happening in QLD not Japan.

At least that is the logic I am given in regards to laws being breeched over state boarders, don't know about international boarders.

I know I am a girl and all and I am not fully understanding but why take pictures of someone only to use them against them in the future? Why bother?

Yeah, but it could be argued all he did was take a screenshot, he wasn't the one taking the photos - in fact that was done by the person in question! It would be no different to taking a screenshot of your desktop with some topless chick on it (since the person put the webcam up publically in the first place).

The person taking the photo has copyright. Which in this case is her. However, if you had taken the photos of her boobs, you'd have copyright.

It is illegal for an entity to make an audio or visual recording of a person without their knowledge
An approved court order is the only way to avoid this.

It is illegal to distribute for commercial purposes without the others written permission.

Thats the way cops tape interviews etc: they just say, this interview will be recording.

they dont need permission too, the other party just has to know the recording is taking place.

The case addresses the issue of the unlawful taking of a photograph e.g. by paparazzi.

[59] Essentially, therefore, the High Court of Australia has not ruled out the possibility of a common law tort of privacy, nor has it embraced it with open arms. As it currently stands, the case law provides this Court with little guidance on relevant principles.

I have witnessed the exact same situation and have on very good authority that if you were to release the picture, SHE would get in trouble for some kind of nudity or something along those lines. This is just what I was told due to witnessing an almost identicle experience with a friend

For the OP just because she lives in Japan doesn't mean squat. At the end of the days you have to abide by our laws, and our laws state you can't show peoples images without their consent.

She hasnt given consent to be recoreded, but she probablly hasnt given consent to be on "video"

Normally (in aus) with photography, if you are in public and take a photo, then thats your right. Thats why paperatzise (spelling) can get away with celb shots with a big fk off lens.

Also, there is a "loop hole" with credit cards. For example, its illeagle to store someones credit card details without their consent. However, buy make a internet purchase with a credit card, the details are "stored" for a short period of time on your isp proxy server, and so on.

So you could argue that by allowing a webstream, you are allowing the viewer to "record" the video.

By giving consent to a webstream, you could argue that the images have to be stored, weather it be in a proxy cache or not, so therefor you are giving consent to be "recorded"
